Greetings!
Is it time for spring cleaning? Maybe you should skip the cleaning and visit Cabo. This is probably the best time of the year to visit. We are through the cold season... I know you might laugh at that, but we did have to wear a light coat some evenings this winter... and summer is just around the corner.

This time of year, real estate does not stay on the market long. If you have considered buying something... don't wait much longer. We have seen at least 10% to 20% appreciation since last year in most neighborhoods.

Why is the market so hot down here? Two reasons come to the top of the list: 1. Financing is now readily available, and 2. Los Cabo is awesome, and easy to get to.

The Fish are Biting!

This week we have a slight increase with 69 percent of the boats catching marlin. Staring on Friday the 23rd, boats started going to the Pacific side again, where the catches were excellent a few weeks ago and they found what they were looking for. Considering that February and March are not the best months for fishing, our boys are doing really well, like La Brisa on the 23rd, releasing five striped marlin for Harry Ellison, Michael Haith, Mike Evans and Scott Andrews form Colorado, that same day, Valerie released three striped marlin for David Manassez and Bob O'Neil from Andover, MA. On February 25th Rebecca released four striped marlin for Cindy Wright and Jeffrey Bimartin from Nevada, and La Brisa released another 3 for Robert Mabry and Denise Jones.


The best day of the week was on February 26th with all the boats coming back with marlin flags, that day Libre released four striped marlin for Bob Torrence and friends from Texas, Valerie released three stripers for Greg Asling, Scott Hoyter and Jim Tobin form British Columbia, Canada. The rest of the boats came back with two marlin released and just two were landed, one was 140lbs and the other 150lbs. C-ROD is the highlight of the week with six striped marlin released for our old friend John Carey from Chesterfield, MO. A total of 80 Striped Marlin were caught and 72 were released.

OTHER SPECIES: Very slow week on Dorado, only two of them were caught, yellow fin tuna was also slow with most of the boats going to the Pacific side and tuna being on the Sea of Cortez, however, our 50ft Sr Moment went about 12 miles from Cabeza de Ballena on the Sea of Cortez and caught 12 Yellowfin tuna between 20 and 30 lbs for Cathy Phillips. Many of our boats caught a lot of Sierras or Spanish mackerel, a couple of Mako sharks ere released.

Can I own real estate in Mexico?

There is a large misconception that foreigners cannot own Real Estate in Mexico. This used to be true and because of that, many people who wanted a home in Mexico were forced to lease land. This is where the "ninety-nine year land lease" confusion began. Today, foreigners can purchase land in Mexico through a Fideicomiso or "Trust."

The Mexican Fideicomiso has its origins in the American Trust. Dating back to the early 20th century, the Fideicomiso was originally adapted from the American trust and tailored to Mexican regulations. The origin of the term Fideicomiso comes from a Roman contract entitled "Pacto de Fuduccia." The Fideicomiso can be applied to any type of contract as long as the purpose of the Fideicomiso is not illegal. The current Mexican constitution was issued in 1917. Within the constitution, article 27 regulates everything concerning the Mexican Territory, ground, underground, sea, waters, natural recourses and general rules concerning property. Article 27 also establishes the "restricted area." The restricted area encompasses 100 kilometers along the border and 50 kilometers along the coast. Article 27 also prevents foreigners from "direct" ownership of property within the restricted area. For this reason, foreigners are allowed to purchase property in and "indirect way." The most common is through a Fideicomiso.

With North American Free Trade Agreement (NAFTA) beginning January 1, 1994, the Foreign Investment Act of 1993 was passed by the Mexican congress to promote foreign investment into Mexico. THis law allowed foreigners to own 100% of the shares of a corporation and purchase property. As a foreigner, you can acquire irrevocable and absolute ownership rights to property in Mexico through a 50 year perpetually irrevocable and transferable Fideicomiso Trust. This enabled foreigners, as beneficiaries of the trusts, to legally enjoy unrestricted use of land located in the restricted area. Fideicomiso is the legal equivalent of deeded ownership (commonly referred to in the U.S. as fee simple).

Upon the purchase of land through a Fideicomiso, the Mexican Government issues a permit to a Mexican band of your choice. Clear, lien-free title to the property is then delivered to that bank. The bank acts as the trustee designating the purchaser as the beneficiary of the trust. The bank acts as an employee of the beneficiary in all transactions involving the property. As the Beneficiary, you retain full use and control of the property and make all decisions concerning the property. Title insurance is also available from U.S. title insurance companies. Owning land in Mexico under a Fideicomiso Trust gives you the right to use, enjoy, lease, improve, mortgage, sell, profit, inherit and will the property.
